The bond/forfeiture amounts have been set for asbestos citations.


Attached is information that Tom Krsnich, the DNR Environmental Warden Supervisor, provided on the bonds for asbestos citations. The amounts are the standard amounts that those receiving citations would have to pay for the specific asbestos administrative code violations. These amounts could be higher or lower based on the judges final decision. Note the higher amounts for the second offense. Any second or subsequent violation occurring within 5 years from the prior court decision would receive the second offense amount.


Here are the bonds:


Failure to conduct a demolition or renovation pre-inspection for the presence of asbestos, s. NR 447.06(1), Wis. Adm. Code, or Failure to follow notification requirements s. NR 447.07(1) and (3) - 1st offense -


Forfeiture - $1,000.00
Penalty surcharge - $240.00
Court Costs - $119.00
Environmental Surcharge - $100.00


Total - $1,459.00


Failure to conduct a demolition or renovation pre-inspection for the presence of asbestos or Failure to follow notification requirements - 2nd offense -


Forfeiture - $2,500.00
Penalty surcharge - $600.00
Court Costs - $119.00
Environmental Surcharge - $250.00


Total - $3,469.00



Failure to follow active waste disposal site requirements for excavating or otherwise disturbing any asbestos containing material s. NR 447.17(1), (2), (3), (4), (5)(a), (6), and (10) - 1st offense


Forfeiture - $2,000.00
Penalty surcharge - $480.00
Court Costs - $119.00
Environmental surcharge - $200.00


Total - $2,799.00


Failure to follow active waste disposal site requirements for excavating or otherwise disturbing any asbestos containing material - 2nd offense


Forfeiture - $3,500.00
Penalty surcharge - $840.00
Court Costs - $119.00
Environmental surcharge - $350.00


Total - $4,809.00
